Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Mybers (the “Service”), operated by Mybers (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization.
1. The Service
Mybers provides membership-management software including member records, dues and payment collection, events, communications, and related AI features. We may update, add, or remove features over time.
2. Accounts and eligibility
You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account and for the conduct of users you invite to your organization. You must be at least 18 years old.
3. Plans, fees, and billing
Paid plans are billed in advance on a recurring basis through our payment processor (Stripe). Usage-based charges (such as AI calling credits) are billed as incurred. Fees are non-refundable except as required by law or as expressly stated. You may cancel at any time; your plan remains active through the end of the current billing period and then downgrades. We may change pricing with reasonable notice.
4. Payments you collect from your members
If you use Mybers to collect dues, donations, or other payments from your members, those funds are processed through your own connected Stripe account. You are the merchant of record for those transactions and are responsible for fulfillment, refunds, taxes, and compliance. Mybers does not take a percentage of the dues or other payments you collect; your plan subscription and any usage-based credits are billed separately as described above.
5. Acceptable use
You agree not to use the Service to send unlawful, deceptive, or unsolicited communications; to violate the privacy or rights of others; to upload malware; to attempt to gain unauthorized access; or to violate any applicable law, including anti-spam (CAN-SPAM) and telemarketing/automated-calling (TCPA) rules. You are responsible for obtaining any consents required before contacting your members by email, SMS, or phone.
6. Your content and data
You retain ownership of the data you and your members submit (“Your Data”). You grant us a limited license to host and process Your Data solely to provide the Service. We process personal data as described in our Privacy Policy.
7. AI features
Some features use AI models to generate text, answer questions over your data, or place calls. AI output may be inaccurate; you are responsible for reviewing it before relying on or sending it. We do not use Your Data to train third-party foundation models.
8. Intellectual property
The Service, including its software, design, and trademarks, is owned by us and protected by law. These Terms grant you a non-exclusive, non-transferable right to use the Service while your account is active.
9. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, non-payment, or abuse. On termination you may export Your Data for a reasonable period, after which we may delete it.
10. Disclaimers and limitation of liability
The Service is provided “as is” without warranties of any kind to the maximum extent permitted by law. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the amount you paid us in the 12 months before the claim.
11. Changes to these Terms
We may update these Terms; material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.
